Two agencies, 140.000 € and 165.000 €. Are they inflating the price?

One agency quoting 165.000 € and another 140.000 € doesn't mean it's worth more: the high figure is usually a bait price to win your listing and push you for reductions later. Real value rests on completed sales in your area (Consejo del Notariado), not on what's asked in the listings. Ask each agency for the comparables its price is based on; the one that hasn't got them is inflating.

Checklist for selling in Torrevieja

Before you list, have ready: an up-to-date nota simple (Land Registry extract), an energy performance certificate, a cédula de habitabilidad (habitation certificate) or second-occupancy licence, your latest IBI (council property tax) and community-fee receipts up to date, and the zero-debt certificate if you have a mortgage. With the paperwork ready you won't stall the sale just when the buyer appears.

How to avoid scams when buying

Before you put down a deposit, check at the Land Registry (nota simple) that the seller is the registered owner and that the property carries no charges or embargoes. Be wary of prices well below the area's and of any rush to take a deposit. If in doubt, have a lawyer review before you sign the arras (deposit contract).

Tax

Non-resident: what taxes do I pay when selling

As a non-resident, the buyer withholds 3% of the price (form 211) on account of your gain, and you settle the IRNR (Non-Resident Income Tax, form 210). Separately there's the plusvalía municipal (municipal land-value tax). If the withholding exceeds what you owe, you claim the refund. Given the sums involved, a tax adviser before signing is worthwhile.

What is an AFO property

An AFO property (Asimilado a Fuera de Ordenación — treated as outside planning regulations) was built without a licence at the time, and the authorities recognise it and allow it to remain, but don't fully legalise it: you can live in it and sell it, with utilities connected, but extensions and certain renovations are restricted. Before buying, request its exact planning status from the town hall and what renovations it allows.
